355. Rev. Henry Benjamin Coffey was born circa 1814 in Amherst Co., VA. He owned on 16 March 1843 in Nelson Co., VA.

This Indenture, made and entered into, this 16th day of March, in the year of Our Lord one Thousand eight hundred and forty three between Benjamin Coffey, the debtor of the first part, and Peter J. Hill the Trustee of the second part, and Wiatt Jones the creditor of the third part, witnesseth: that whereas the said Benjamin Coffey, stands justly indebted to the said Wiatt Jones, in the sum of one Hundred and Forty Seven Dollars and Fifty Eight Cents due by Bond and carrying Int. from the first day of September 1842 and bearing date the fifteenth day of October 1842 as will more fully appear by a reference to the said Bond, with legal interest thereon accruing; the said Benjamin Coffey is willing and desirous to secure. Now This Indenture witnesseth, that for and in consideration of the premises aforesaid, and for and in consideration of the further sum of One Dollar lawful money of this Commonwealth, to him the said Benjamin Coffey, in hand paid by the said Peter J. Hill, the receipt whereof is hereby acknowledged, the said Benjamin Coffey hath bargained, sold and by these presents doth hereby grant, bargain, sell, deliver and confirm unto the said Peter J. Hill, his heirs, Exors, adms. or assigns, forever, the following property to wit: one third part of the following slaves, Will, to Nancy Coffey during her life, by Peter C. Jacobs, and at her death to her three children, Candice Coffey, Sophia & Ann to wit: Jack a man, Isbel, a woman, Ancel a man, Sally a woman, & Harriet a girl, and Washing, a boy, children of Sally since the death of Peter C. Jacobs and all thare future increase, one red cow, one brindle cow, fourteen head of hogs, one shot gun, two beds, bed steads and furniture, the crop of rye now growing, the crop of corn growing made the present year & all the household and kitchen furniture of all kinds, plantation utentials of every kind, to have and to hold, the aforesaid property to him the said Peter J. Hill, his heirs, Exors., adms. and assigns forever free from the claim or claims of all and every person or persons whatsoever; and the said Benjamin Coffey for himself his heirs, Exors. and adms. to and with the said Peter J. Hill, his heirs, adms. and assigns to warrant and defend forever a good and lawful right title and interest in and to the aforesaid slaves and other property upon this special trust nevertheless, that if the said Benjamin Coffey shall will and truly pay the debt within mentioned with the legal interest thereon accruing and all cost attending the execution of this trust on or before the first day of January 1844, this indenture will be void and of no effect; but in case the said Benjamin Coffey shall make default in the premises and fail to pay the debt with legal interest and cost at the time aforesaid it shall be lawful and right for the said Peter J. Hill his heirs, Exors adms or assigns upon the happening of such default or at the request of said Wiatt Jones, his heirs, Exors & co to sell the aforesaid property and interest for the best price that can be obtained in ready money or so much thereof as will be sufficient to pay the debt interest and cost aforesaid, first advertising the time and place of sale at one or more publick places at least ten days before the day of sale which sale is to be at or in the neighbourhood of said Benjamin Coffey and out of the money arising from such sale first pay and satisfy all cost attending the execution of this trust and in the second place debt with the legal interest thereon and lastly the balance if any pay to the said Benjamin Coffey or his legal representatives. In testimony whereof the parties have hereunto set their hands and affixed their seals the day and year first above written.

This day Benjamin Coffey personally appeared before Wm. Massie, and Edmund F. Coffey, Justices of the Peace for the County of Nelson, and acknowledged the foregoing Deed of Trust to be his act and deed and desired us to certify the same to the Clerk of the County Court of Nelson in order that it may be recorded. As witness our hands and seals this 16th day of March 1843.

This Deed made the 26th day of October 1850 between Benjamin Coffey of the one part and Jacob Warrick of the other part: Witnesseth: that the said Benjamin Coffey doth grant unto the said Jacob Warrick the following property: one bay horse, one red cow, one pied cow and red calf all his household and kitchen furniture and one third part of all the slaves willed to Nancy Coffey during her life (by Peter Jacobs decd. as per will of record in Clerk's Office of Nelson County) with remainder over to her three children, Sophia, Ann and Candy Coffey to Wit. Jack, Isbell, Ancell, Sally, Harriet, Washington, Milly, Eliza, Rose and infant girl daughter of Sally & all the future increase of the females. In trust to secure the payment of a bond executed to Tho. P. Massie of the date of these presents for the sum of one hundred and twenty dollars and 63 cents. Now this deed Witnesseth that if the said Benjn. Coffey pays or causes to be paid unto the said Thomas J. Massie his heirs or assigns the debt (with full interest) above mentioned on or before the 26th day of October one thousand eight hundred and fifty two, then this deed shall become null & void otherwise the said Jacob Warrick shall on the premises on the said 26th day of October 1852 after having given 30 days notice in the public places of the neighbourhood proceed to sell for cash or on such credit as he may deem best, the said property whether in possession or remainder or so much of it as may be necessary to pay the debt aforesaid and after paying said Massie his debt to pay the balance if any to the said Benjamin Coffey or his assigns. In witness whereof the parties have hereunto set their hands and affixed their seals.

Coffey whose name is signed to the within deed of trust bearing date of the 26th day of October 1850, has acknowledged the same before me in my County aforesaid. This Deed made this 22nd day of December in the year A. D. one thousand eight hundred and sixty two between Seaton H. Loving Clerk of the County Court of Nelson County of the one part and Henry B. Coffey of the said County of the other part. Witnesseth.

That whereas the said Henry B. Coffey became the purchaser of the following tract of lands sold for errears (sic) of taxes under the laws of the Commonwealth of Virginia and whereas by the laws of said Commonwealth the Sheriff of Nelson County was directed to sell all delinquent lands taxed by law on which the taxes had not been paid or which had been taxed and liable to be sold for the non payment of taxes, as more particularly described by the Statute laws of Virginia, reference to which is here made for greater certainty, as bearing on the land hereinafter mentioned and without reciting the said laws. And whereas Dennette (?) A. Witte Sheriff of the said county did after having done and performed all things acquired by the Sheriff in such cases to be done and performed by the said laws of the Commonwealth previous to the day of sale herein after named, did on the 24th day of September 1860 (that day being court day, held at the court house of Nelson County, at the place required by law, at said court house), __posed to public sale according to law, the following tract of land, among a number of other tracts, sold for the non payment of taxes, to wit: one tract of one hundred and two acres taxed in the name of Wm. Coffey deceased, as Lot No. 2, Estate of Edmund Coffey (it should be Lot No. 3) for the non payment of taxes in and for the years 1857, 1859 amounting to $2.69 (two dollars & sixty nine cents) and the said Henry B. Coffey having become the bidder for the whole tract at the price mentioned, and no person being willing to pay the taxes hereon for a less number of acres or quantity of land, the said tract of land was __?__ off to him the said Henry B. Coffey as the purchaser for and on the terms aforesaid.

And whereas it is represented to the said Seaton H. Loving Clerk as aforesaid, that the said tract of land, (nor any part thereof) has been redeemed or offered to be redeemed, in the mode required by law, and no person having deposited with said Clerk any certificate of redemption of said tract of land sold as aforesaid. And whereas the time of redemption has fully expired, and the said Henry B Coffey having required of said Seaton H. Loving Clerk as aforesaid to make him a deed to said tract of land in the manner prescribed by law, he having complied with the terms of sale on his part.

Now for and on consideration of the premises, and in pursuance of the powers vestide (sic) in me by law, and the further consideration of one dollar to me in hand paid by the said Henry B Coffey. Before the sealing and delivery hereof I, Seaton H. Loving Clerk of the county court of Nelson County do hereby grant and convey to the said Henry B. Coffey, his heirs executors administrators and assigns forever, all such title and estate in and to the aforesaid tract of land purchased as aforesaid and (according to a plat and division of the lands of Edmund Coffey deceased, recorded in Will Book D. page 71 in this office) bounded as follows, to wit: Beginning at a Beech at H on the north side of the North Fork of Tye River near the mouth of Pannels Branch and running thence N53 E49 po. to pointers at I thence N76 E88 po. to a Chesnut (sic) S. 33. E 45 po. to Pointers S 35. W 136 po. to Chesnut (sic) Oak, S 60 W. 90 po. to a fallen down White Oak on the north bank of said River at K, & thence up the north banks of the same as it meanders 155 po. to the beginning, it being Lot No. 3 and contains 102 acres, as was, at the day of sale thereof herein before recited vested in the said William Coffey deceased. To have and to hold the said tract of land to the said Henry B. Coffey, his heirs __?__ But the said Seaton H. Loving Clerk as aforesaid, merely executing the power under the authority aforesaid, undertakes to convey no warranty whatever concerning the same.

In the Clerks Office of Nelson County Court May 25th 1865- This deed was this day presented in said office and acknowledged by S. H. Loving party hereto, and admitted to record. Teste Geo. S. Stevens, D. C. Rev. Coffey died in March 1879 at the age of 65 in Virginia and was buried at Henry B. Coffey Family Cemetery in Nelson Co., VA.

Rev. Henry Benjamin Coffey and Mary Sarah "Polly" Campbell were married on 22 December 1834 in Nelson Co., VA.1221 They1221 appeared in the census on 31 October 1850 in Nelson Co., VA.1222 They1222 appeared in the census on 27 August 1860 in Nelson Co., VA.1223 Henry and Polly1223 appeared in the census on 6 September 1870 in Nelson Co., VA.1224 Mary Sarah "Polly" Campbell, daughter of Francis Jefferson Campbell and Nancy Coffey, was born circa 1808. She lived with her son Benjamin in Nelson Co., VA on 30 June 1880. Mary died circa 1895.

Rev. Henry Benjamin Coffey and Mary Sarah "Polly" Campbell had the following children:

Henry J. Coffey was born in May 1850. He lived with his parents in Nelson Co., VA on 31 October 1850. Henry apparently died young. He does not appear with the family in the census of 1860 or 1870.

Based on his absence from the family in the 1870 census, it is likely that Henry died while still very young.
